As a landlord of commercial property, you may recover commercial rent arrears under CRAR. CRAR (Commercial Rent Arrears Recovery) replaced distress for rent with the enforcement of the Trbunals, Courts and Enforcement Act 2007 in 2014.

The act provides for a commercial landlord or its agent to use schedule 12 of section 72 of the act when taking control of goods in order to recover rent payable. This avoids the need to go to court.

If Commercial Rent Arrears are Recovered within 7 days then the matter is closed

If Commercial Rent Arrears are not Recovered within 7 days then the matter is referred back to you or your agent in order to seek authorisation in writing for a Debt Squared Group enforcement agent to attend the premises.

How does CRAR – Commercial Rent Arrears Recovery apply?

CRAR, Commercial Rent Arrears Recovery, ONLY applies to Commercial Rent and specifically NOT Residential Rent

CRAR, Commercial Rent Arrears Recovery may only commence if the arrears are more than 7 days overdue

CRAR, Commercial Rent Arrears Recovery RELIES on there being an existing written and agreed lease or in the event of this not being the case, proof of a tenancy at will arrangement.

CRAR, Commercial Rent Arrears Recovery collects Rent Arrears only including Interest and VAT – it does not apply to Insurance costs or VAT for example. Service Charge Arrears may be collected separately by Debt Squared Group under the Service Charge Arrears Recovery service.

Taking Control of Goods

When a Debt Squared Group Enforcement Agent attends a premises, an attempt will be made to either take control of goods, sufficient to cover the value of the debt, or collect your arrears in addition to Debt Squared Group’s charges.

The Enforcement Agent will seek to either

  • Enter into a Controlled Goods Agreement that will be secured against the property owned by the debtor
  • Secure goods on part of the premises (securely locked up)
  • Remove items to the value of the debt and charges to be stored ready for sale with the proceeds aimed at settling the debt

A controlled goods agreement effectively secures your debt against the value of goods owned by the tenant AND importantly, once a controlled goods agreement is entered into, your tenant has time in order to organise its financial affairs.
